Ch 36 - Planning Board

Article I - Establishment and Form

[Article 1, adopted 5-25-57] by a special Town Meeting, reads as follows:

"To see if the Town will vote to establish a Planning Board of seven members with duties as set forth in sections 1-15, Chapter 36, N.H. Revised Statutes Annotated, 1955, to make a study of the Town's development and report to the Town appropriate recommendations for the promotion and maintenance of the Town's best development. The Board members shall consist of one Selectman and six other citizens appointed by the Selectmen as provided in Chapter 36, N.H. Revised Statutes Annotated 1955."

The Planning Board was reaffirmed and reorganized by Art. 5, adopted 3-13-79 by the Annual Town Meeting, which reads:

"To see if the Town will vote to establish a Town of Conway, New Hampshire Planning Board, such board to consist of seven (7) members and three (3) alternates, all to be appointed by the Selectmen for staggered terms as per New Hampshire Revised Statutes Annotated 36:5, II and 36:7-a, 1.: "The selection procedure for Planning Board members was amended by Article 4, adopted 3-11-80 by the Annual Town Meeting, which reads: "To see if the Town will vote to adopt the procedure to elect the members of the Conway Planning Board to consist of seven members at the next annual Town Meeting, all pursuant to RSA 36:4 as amended."

Article II - Subdivision, site Plan and Plat Approval Powers

Article 16, adopted 3-10-70 by the Annual Town Meeting, reads as follows:

"To see if the Town will vote to authorize and empower the Planning Board to approve or disapprove, in its discretion, new subdivisions as provided in Chapter 36, Sec. 19-29 inclusive, of the New Hampshire Revised Statutes Annotated 1955."

Article 6, adopted 3-13-79 by the Annual Town Meeting, reads as follows:

"To see if the Town will vote 'to authorize and empower the Planning Board to approve or disapprove, in its discretion, plats showing streets, or widening thereof, or parks,' (to adopt and administer subdivision regulations) and make it the duty of the Town Clerk to file a notice with the Register of Deeds of Carroll County that the Town of Conway Planning Board has been so authorized in accordance with New Hampshire Revised Statutes Annotated 36: 19, 36: 20, 36: 21."

Article 28, adopted 3-10-82 by the Annual Town Meeting, reads as follows:

"To see if the Town will vote to authorize and empower the Town of Conway Planning Board to review and approve or disapprove site plans for the development of tracts for non-residential uses and mufti-family dwelling units, whether or not such development includes a subdivision or re-subdivision of the site, as provided by Chapter 36, Section 19a, New Hampshire Revised Stated Annotated, 1955, as amended."

Article 35, adopted 3-14-89 by the Annual Town Meeting, reads as follows:

"To see if the Town will vote to amend the present authority of the Planning Board to review and approve or disapprove site plans for the development of non-residential uses and mufti-family dwelling units consisting of more than two dwelling units so as to include the authority to review and approve or disapprove site plans for the development or change or expansion of use of tracts for non-residential uses or for mufti-family dwelling units which are defined as structures containing more than two dwelling units all pursuant to RSA 674:43; and it shall be the duty of the Town Clerk to file with the Carroll County Registry of Deeds a Certificate of Notice of this amendment showing that the Planning Board has been so authorized and giving the date of such authorization."
